Hearing Set for Lawsuit

by Robert LatteryA hearing has been set for the parties involved in the lawsuit that will determine the fate of the development adjacent to the Ingles Grocery Store near Summit Point in Fayetteville, Georgia. The hearing is scheduled for Tuesday, August 8, 2017 at 1:30 p.m. at the Pike County Courthouse in Zebulon, Georgia.
The lawsuit was filed against the Summit Point HOA, the Sheffield Estates Community Association, the City of Fayetteville, and former Fayetteville Planning Commissioner and developer Steven Gulas and his wife Deborah by developer Bob Rolader. Rolader is asking for a court ruling on the Southside Development Agreement and whether it remains in force. The Southside Development Plan calls for the development of 300,000 square feet of retail space and townhomes. The other parties in the lawsuit want Rolader to continue to use the guidelines in the Southside Development Agreement for future development of the area and do not want the area rezoned for other purposes.
Attorney Scott Bennett has asked that those who are named on the suit be present and has advised that there is no need for others to attend. However, the public is welcome to attend as long as they respect the court's dress code and decorum. Visitors must remain quiet during the proceedings and should not bring children.
